User Responsibilities

Eligibility, Accounts, and User Responsibilities

The Service is intended only for individuals capable of entering legally binding agreements under applicable laws in their jurisdiction.

By using TimeCapsule, you represent that:

  • the information you provide is accurate and current

  • you are not impersonating another person or entity

  • you are authorized to submit any personal information or recipient details entered into the platform

  • you are using the Service lawfully

Where account registration is available, you remain fully responsible for all activity conducted through your account, including maintaining the confidentiality of passwords, credentials, and recovery details.

You must immediately notify the platform if you suspect unauthorized account access, compromise of credentials, or misuse associated with your account.

The platform may suspend, restrict, or terminate access where misuse, suspicious activity, abuse, fraudulent conduct, technical harm, or repeated violations are detected.

Guest users remain equally bound by these Terms even without formal account creation.

Capsule Creation

Capsule Creation, Content Submission, and Platform Rules

TimeCapsule allows users to create digital capsules intended for future delivery, retrieval, publication, or release.


Capsules may include:

  • written messages

  • images

  • videos

  • attachments

  • links

  • recipient details

  • access instructions

  • security prompts where enabled

Users remain fully responsible for all submitted content, including ensuring that uploaded content does not violate law, intellectual property rights, privacy rights, or platform content standards.


You agree not to create capsules containing:

  • unlawful material

  • harassment or threats

  • abusive or hateful content

  • explicit illegal content

  • malware or harmful technical material

  • fraudulent communications

  • impersonation content

  • content designed to manipulate, deceive, or cause harm

The platform does not actively pre-screen every private capsule but reserves the right to investigate reported abuse, suspicious content, or operational threats where legally necessary or technically required.

The platform also reserves discretion to reject, remove, or disable content that may expose the platform, its users, or third parties to legal or operational risk.

Private & Public Capsules

Private Capsules, Public Capsules, and Future Release

Users may create capsules under available privacy models offered by the platform.

Private Capsules

Private capsules remain restricted until the reveal date and may require retrieval credentials, security answers, private links, or account verification depending on user settings and product configuration.

The platform does not disclose private capsule content publicly unless legally required.

Public Capsules

Public capsules may become visible on the platform’s public timeline once the reveal date arrives and after moderation or review where applicable.

Public content may remain searchable, viewable, shareable, or archived depending on platform publishing behavior.

The platform reserves editorial discretion over public capsule publication and may refuse public visibility for content that conflicts with moderation standards, legal obligations, platform safety, or public policy concerns.

Users acknowledge that public capsules, once released publicly, may be accessed by other users and may be indexed where technically permitted.

Payments & Refunds

Payments, Paid Services, Refunds, and Transaction Terms

Certain capsule types, premium features, delayed delivery services, or future platform services may require payment.

Where payment applies:

  • all pricing displayed at checkout forms part of the purchase agreement

  • payment processors operate independently under their own regulated systems

  • payment authorization must complete successfully before protected features are activated

The platform may update pricing, payment plans, or premium structures at any time without affecting already confirmed purchases unless required operationally.

Refunds

Because digital preservation services may begin processing immediately upon confirmation, refunds are generally limited.

Refunds may be considered only in exceptional circumstances including:

  • duplicate charges

  • confirmed payment system errors

  • failed premium activation caused solely by platform fault

Refund approval remains discretionary unless otherwise required by applicable consumer law.

Administrative review may be required before any refund decision.

Approved refunds may be partial or full depending on circumstances.

Service & Security

Service Availability, Security, and Technical Risk

The platform uses commercially reasonable efforts to preserve availability, reliability, and secure storage.

However, no digital platform can guarantee uninterrupted operation.

Users acknowledge that temporary interruptions may occur due to:

  • infrastructure maintenance

  • software updates

  • cloud service interruptions

  • network failures

  • third-party provider disruptions

  • security interventions

The platform does not guarantee that future delivery, publication, or retrieval will occur without technical dependency on systems beyond direct control.

Reasonable recovery efforts will always be prioritized where failures occur.

Users further acknowledge that no digital storage environment can guarantee absolute immunity from technical failure, data corruption, cyberattack, or force majeure events.

Intellectual Property

Intellectual Property, Liability, and Legal Limits

All software, design systems, visual assets, platform structure, trademarks, workflows, databases, and proprietary logic remain the exclusive property of TimeCapsule unless otherwise stated.

Users retain ownership of submitted content but grant the platform limited operational rights necessary to:

  • store content

  • process scheduled release

  • generate retrieval mechanisms

  • deliver public publication where selected

To the maximum extent permitted by law, the platform shall not be liable for:

  • indirect losses

  • emotional harm arising from delayed content access

  • delivery failure caused by incorrect user data

  • recipient email failure

  • user misunderstanding of reveal dates

  • third-party misuse after lawful public release

Liability, where legally applicable, shall be limited to amounts directly paid for affected services where payment occurred.
